Can the Realtors Association of Jamaica Sue a Real Estate Company?

The Realtors Association of Jamaica (RAJ) (The Voice for Real Estate) is a private membership organization that represents licensed real estate professionals in Jamaica. In some cases, it may take legal action against a real estate company under the following circumstances:

1. Trademark or Brand Infringement

  • If a company or website uses RAJ’s name, logo, or branding without permission, RAJ could sue for intellectual property infringement.
  • Misrepresenting affiliation with RAJ when not a member could also lead to legal action.

2. Defamation or False Statements

  • If a company or website spreads false or damaging information about RAJ, its members, or the organization itself, RAJ could pursue a defamation lawsuit.

3. Violation of Membership Agreements

  • If a registered member company violates the RAJ’s Code of Ethics or Rules and Regulations, the association may take disciplinary action, including revoking membership and possibly suing for damages.

4. Unauthorized Real Estate Practices

  • If a company operates as a real estate brokerage or agent without being licensed by the Real Estate Board of Jamaica (REB), RAJ could report the matter to the REB for legal enforcement. While RAJ itself may not sue directly in this case, it could push for government action.

5. Fraudulent or Misleading Advertising

  • If a website falsely claims to be an official RAJ partner or misleads consumers about real estate transactions, RAJ could pursue legal action based on false advertising or fraud.

While RAJ may not always be the direct party to sue, it can file complaints with the Real Estate Board of Jamaica or other relevant authorities to take enforcement action.
