    Intellectual Property Notice

    This Intellectual Property Notice forms part of the Terms of Use of Jamaica Homes and is governed by the laws of Jamaica.

    Jamaica Homes respects intellectual property rights and expects all users, contributors, agents, advertisers, and guest authors to do the same.


    1. Ownership of Jamaica Homes Content

    Unless expressly stated otherwise, all original content published on Jamaica Homes — including text, design, branding, layout, logos, graphics, and the majority of images — is the property of Jamaica Homes and is protected under:

    • The Copyright Act of Jamaica
    • Applicable intellectual property laws
    • International copyright conventions where applicable

    A substantial majority (approximately 90% or more) of the content on this website is owned, created, licensed, or commissioned by Jamaica Homes.

    You may not:

    • Reproduce
    • Republish
    • Scrape
    • Distribute
    • Modify
    • Commercially exploit

    any material from this website without prior written permission.

    2. Third-Party & Contributor Content

    Jamaica Homes allows third parties to submit content, including:

    This content remains the responsibility of the person or entity who submitted it.

    Jamaica Homes does not warrant, guarantee, or independently verify that third-party submissions are free from copyright restrictions.

    By submitting content, contributors confirm and warrant that:

    • They own the intellectual property rights; or
    • They have obtained all necessary licences and permissions; and
    • The material does not infringe any copyright, trademark, or other proprietary right.

    Contributors agree to indemnify and hold harmless Jamaica Homes from any claim, demand, loss, liability, cost, or legal expense arising from their submission.


    3. Good Faith Publication

    Jamaica Homes publishes third-party materials in good faith.

    We reasonably rely on contributors’ representations that submitted content is lawful and properly licensed.

    We are not obligated to:

    • Conduct licensing investigations
    • Monitor external image databases
    • Verify the continuing availability of third-party image sources

    If an image was sourced from a legitimate platform at the time of publication but later becomes unavailable or disputed, Jamaica Homes shall not be liable for that change in status.


    4. Copyright Complaints & Takedown Procedure

    If you believe your copyright has been infringed, you must send a written notice including:

    • Your full legal name and contact information
    • Identification of the copyrighted work
    • The exact URL of the alleged infringement
    • Evidence of ownership or authority
    • A statement that your claim is made in good faith

    Notices should be sent to:

    Subject: Copyright Claim

    Upon receipt of a credible and properly supported complaint, Jamaica Homes may:

    • Temporarily remove the material
    • Disable access to the content
    • Notify the contributor
    • Request clarification from the contributor

    We reserve the sole discretion to determine whether content will remain removed.


    5. Removal Without Admission of Liability

    Where a dispute arises, Jamaica Homes may remove content as a precautionary measure.

    Removal of content does not constitute:

    • An admission of infringement
    • Acceptance of legal liability
    • A waiver of rights

    Content may also be removed if required by Jamaican law or by order of a court of competent jurisdiction.


    6. Disclosure of Contributor Information

    Jamaica Homes respects user privacy.

    We will not disclose contributor details unless:

    • Required by a valid court order; or
    • Required under Jamaican law.

    In the absence of a court order, contributor information will not be released to third parties.


    7. Limitation of Liability

    To the fullest extent permitted under Jamaican law:

    Jamaica Homes shall not be liable for any copyright infringement arising from third-party submissions.

    We act as a platform provider and intermediary for content supplied by independent contributors.

    Users access and rely on third-party content at their own risk.


    8. Repeat Infringers

    Jamaica Homes reserves the right to:

    • Suspend accounts
    • Remove listings
    • Terminate contributor access

    where there is evidence of repeated intellectual property violations.


    9. Governing Law

    This Intellectual Property Notice shall be governed by and interpreted in accordance with the laws of Jamaica.

    Any disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.


    Jamaica Homes is committed to respecting intellectual property rights while providing an open platform for property listings and real estate discussion.
