A Commissioner of Lands holding means the property is still on the books as Government land, under the legal custody of the Commissioner of Lands, until it is officially transferred into private hands.

    Definition

The Commissioner of Lands in Jamaica is a government official empowered under the Crown Property (Vesting) Act and related laws to hold, manage, and dispose of lands that are vested in, acquired by, or otherwise owned by the Government of Jamaica.

When a title shows the Commissioner of Lands as the registered proprietor, it means that:

    • The land is legally owned by the Government of Jamaica.
    • The Commissioner holds it “in fee simple” (full ownership) on behalf of the State.
    • Any allocation, lease, or sale of the land must be processed through the Commissioner of Lands / National Land Agency (Estate Management Division).

Practical meaning of a “Commissioner of Lands holding”

    • It is essentially government-owned land, even if private individuals may be occupying or have paperwork suggesting an interest.
    • If someone claims ownership based on old paperwork, the land has not yet been formally transferred or divested out of Government ownership.
    • Until a registered transfer, lease, or vesting order is lodged and recorded, the Commissioner of Lands remains the legal owner on the Certificate of Title.
