A $190 Million Apartment Complex Fight Just Reached the Court of Appeal

Jamaicas Court of Appeal has partially overturned a Supreme Court ruling that had invalidated approvals for a $190 million apartment complex in St Andrew, in a long-awaited judgment that upheld the environmental permit issued to developer WAMH Development Limited while narrowing, rather than removing, enforcement orders against the company, according to the Gleaner.

The Supreme Court had originally found that the Kingston and St Andrew Municipal Corporation acted outside its legal powers by granting building and planning approval before the required environmental permit was actually issued, calling the sequencing a matter of substance and not merely convenience. The Court of Appeal disagreed on that specific point, unanimously ruling that both the environmental permit granted by the National Environment and Planning Agency and the building approval issued by the KSAMC were valid after all.

The court did not hand developers a clean win. Enforcement orders against WAMH for permit breaches were upheld, just on narrower terms than the original Supreme Court ruling had imposed. Community residents who brought the original challenge had argued they had a legitimate expectation to meet with NEPA before the permit was granted, a claim the court did not accept as grounds for further orders against the agency. The judgment, delivered after residents raised questions about the timing of permits under both the NRCA Act and the Town and Country Planning Act, ran 136 pages, with the court apologising for the delay given the length and complexity of the issues involved.

For developers and community groups alike, the case is a live reminder that Jamaicas layered approval process, environmental permit, then planning approval, then building approval, creates real legal exposure at every sequencing step, and that a project can proceed for years under approvals a court later has to spend 136 pages sorting out.
