Homes on Church Land Despite Local Zoning? Arizona Lawmakers Advance a Bill With a 40 Per Cent Affordability Rule

Arizona lawmakers are considering letting churches build affordable homes on their land even where local zoning says no. KJZZ, carrying a report by Greg Hahne and Howard Fischer of Capitol Media Services, said a bill to allow such development had advanced in the state House.

Under the bill, religious institutions could build affordable housing on their property regardless of local zoning restrictions. At least 40 per cent of the units would have to serve low-income families. Development would be prohibited within half a mile of industrial areas, airports or military bases. The sponsor, Republican Rep. David Livingston, planned amendments before a vote of the full House.

Democratic Rep. Lorena Austin supported the measure, pointing to housing costs: “We have townhouses in my district going for $350,000.” Rep. Stephanie Stahl-Hamilton, a Tucson Democrat, abstained in committee, saying: “I am at odds with how to represent my constituents in this piece of legislation.”

The report did not name specific churches or cities involved.

Laws like Arizona’s proposal shift power from local councils to landowners, in this case churches, and that is why they are contested. For churches, a guaranteed right to build can turn idle land into homes without long zoning fights. For neighbours and councils, it removes a layer of local control. Jamaica has no such law, and church housing there depends on normal planning approval. Churches with land could still prepare by mapping what they own, what it could hold and which partners could help, so they are ready if policies change. Early talks with the local authority can also show which sites are most likely to win approval.
