A life estate is a legal arrangement in real estate where an individual, known as the life tenant, is granted the right to use and enjoy a property for the duration of their lifetime. The life tenant has the ability to live in the property, rent it out, or otherwise manage it while they are alive. However, their rights to the property terminate upon their death, at which point the property passes to a designated individual or entity, known as the remainderman or reversioner, who then gains full ownership. The primary purpose of a life estate is to ensure that property is used or occupied by a person during their lifetime while establishing clear instructions for the property’s future disposition. This arrangement can be advantageous for estate planning, allowing property to be transferred in a controlled manner, often to avoid probate and reduce estate taxes. The life tenant’s rights are limited to their lifetime, and they cannot sell or transfer the property in a way that would affect the remainderman’s future interest.
