Property tax in Jamaica is assessed annually by the Tax Administration Jamaica (TAJ) and is a charge on all registered land. Owners who fail to pay their property tax accumulate arrears, and the TAJ has statutory powers to pursue recovery including, in cases of persistent non-payment, the initiation of a sale process to recover the outstanding amount from the proceeds. This process is governed by the Property Tax Act and includes notice requirements designed to ensure the registered owner is aware of the proceedings before any forced disposal takes place.
Tax sale fraud exploits two vulnerabilities. The first involves fraudsters who falsely inform a property owner that their property is about to be sold for tax arrears and offer to “help” by paying the alleged arrears in exchange for a transfer of the property or a payment from the owner. This scheme targets owners who do not check their own tax records and who panic at the suggestion of losing their property. The second is more sophisticated: a fraudster obtains information about a property whose registered owner has an outdated address on file with TAJ, arranges for tax notices to be diverted or ignored, and then seeks to take advantage of the tax default process to acquire the property at a fraction of its value.
Protecting Your Property from Tax-Related Fraud
Every landowner in Jamaica should verify their property tax status directly with the TAJ at least once per year, and should ensure that their current contact address is registered with both the TAJ and the NLA. This is especially important for diaspora owners and for persons who have recently moved. Property tax status can be checked online or at any TAJ office; guidance is available at jamaicatax.gov.jm. Any communication claiming that a property is in arrears or at risk of sale should be verified directly with the TAJ before any payment or transaction is made in response.
