A tenancy agreement, often called a lease or rental agreement, is the contract that sets the terms on which a tenant occupies a landlord’s property. In Jamaica it can be oral, but a written agreement signed by both parties is far easier to rely on if anything goes wrong.
What it normally covers
A sound agreement names the parties and the property, states the rent, due date and method of payment, the security deposit, and whether the tenancy is for a fixed term or runs month to month. It should deal with who pays utilities, maintenance and repair responsibilities, use of the premises, subletting, pets, guests, notice periods and the procedure for returning the deposit. An inventory is useful for furnished lettings.
The law in the background
The contract does not override statute. Where premises are controlled under the Rent Restriction Act, that law limits rent increases and the grounds on which the landlord can end the tenancy, and the landlord cannot remove a tenant without due process. Commercial premises and some others may be exempt through a certificate from the Rent Assessment Board. An attorney can advise on longer or commercial leases, which raise more complex issues.
Overseas landlords commonly use a local property manager to sign and enforce agreements on their behalf.
