In Jamaica’s residential property market, buyers who cannot self-finance a purchase typically seek a mortgage from a building society, commercial bank, or the National Housing Trust. Some buyers also engage mortgage brokers — intermediaries who claim to have relationships with multiple lenders and who offer to identify the best available mortgage product for a fee. Where a legitimate, properly registered broker is involved, this can add value. Where a fraudulent operator presents themselves as a broker, the result can be devastating for a buyer who relies on a fabricated pre-approval to sign a sale agreement and pay a non-refundable deposit.
Common schemes include: brokers who issue pre-approval letters on official-looking letterhead from lenders that do not exist or have not in fact approved the application; brokers who collect substantial upfront processing or arrangement fees and then disappear or produce endless reasons why the loan has been delayed; and brokers who represent that they have a special relationship with private or offshore lenders operating outside the regulated financial sector. Buyers who discover that their mortgage pre-approval was fraudulent typically find that the sale agreement they have signed provides no protection if they cannot complete, and the deposit paid to the seller is forfeited.
Verifying Brokers and Lenders
Mortgage brokers and financial intermediaries in Jamaica operate under the oversight of the Financial Services Commission (FSC). Buyers should verify that any broker they engage holds a current FSC licence and should check the lender’s identity independently before relying on any pre-approval letter. The NHT’s mortgage products can be checked directly at nht.gov.jm, and the FSC’s register of licensed financial intermediaries is available at fscjamaica.org. Buyers should never pay a mortgage arrangement fee in cash to an individual and should always obtain a receipt for any fees paid.
