A significant proportion of Jamaican households are formed by couples in common law unions rather than formal marriage. The property rights of common law partners in Jamaica differ significantly from those of married spouses, and misunderstanding of these differences has led to disputes and fraud when a union ends or one partner dies. The Property (Rights of Spouses) Act only applies to married couples.
