Jamaica’s Natural Resources Conservation Authority Act requires that certain categories of development — those that may have a significant impact on the environment, including large residential subdivisions, coastal developments, and projects in environmentally sensitive areas — obtain an environmental permit or complete an Environmental Impact Assessment (EIA) before proceeding. NEPA administers this process and has the authority to approve, require modification of, or refuse development applications on environmental grounds. A developer who proceeds without the required approval is in breach of the law and risks enforcement action, including project suspension.
Environmental compliance fraud occurs when a developer presents a fabricated or altered NEPA approval to investors, lenders, or pre-sale buyers in order to give the impression that the project has lawful clearance when it does not. This fraud is particularly harmful to off-plan buyers who invest significant deposits on the basis of documents they cannot easily verify. When NEPA investigates and discovers the non-compliance, the development may be halted, partially built units may be uninhabitable, and the developer may face prosecution — leaving buyers with no completed property and limited prospects for recovery of their deposits.

NEPA maintains records of all environmental permit and EIA decisions. Buyers and investors in any significant development project should request to see the original NEPA approval and verify its authenticity directly with NEPA before committing funds. NEPA’s permit and approval register is accessible and its contact information is available at nepa.gov.jm. Off-plan buyers should also ensure that their sale agreement includes a condition allowing withdrawal if any required regulatory approval is found to be invalid or is revoked.
